I was in a minor car accident. I just find out that i have to subpoena the lady to court. I hit her car but she made a illegal turn, so she is at fault. Since i was not on the insurance policy for my car, i now have to take her to small claims court. While i was out getting quotes from different collision centers, i was told that the second person on the police report is the one that wins the case. Is this true? I rushed home and purchased the police report online. On the police report, i was listed second so i was just wondering if that wins the case for me? if not, i have enough evidence to prove i wasn’t at fault but i was just wondering about the police report information i received. so basically my question is: if a person is listed second on the police report, does that mean that person wins the case???

    I cannot speak for your last question. But it sounds like the other chick is the one that is in trouble because she did an illegal turn. You wouldn’t have hit her if she hadn’t done that.
