Hello, I live in Maryland. Debt buyer filed sued this month. The account was charged off 12/2012.

Maryland SOL is 3 years. I made a $ 10 payment August 2012 to the OC that was below the minimum due. The box for Aug on my report says 60. Some are saying that the payment in August didn’t reset the SOL because it didn’t bring the account current.  Some are saying it did.  Any Idea if I can file SOL expiration as my answer to the summons?  Maryland law states: 

The 3 year statute of limitations begins again if creditors can document that a debtor has reaffirmed a debt by a good faith basis by a written agreement, orally, or by payment.  Thanks
