hi i live in pa and im being hassled by a collection agency over and old contract i defulted on with guardian protection home securty the sent me a letter in november 2005 and i called them and set up a repayment plan but they are posting negitive on my credit report i never stoped paying them there repayment plain so now im asking my self how did they come up with the dollar figure they say i owe them so is it to late to send them a verication of debt letter and is there a statute of limitations

    You need to go back to the orginal company, demand a copy of your bills. Then ask the collector for a mailed copy of your bills. Advise them that you are disputing the debt (in writing). Then, notify the credit bureau.

    I would give them a call bright and early tomorrow morning. Write down the name(s) of the individuals you are speaking with. Explain to them the situation and you will probably be referred to someone else.

    I think this whole credit thing has gotten way out of control. Even if a company makes a mistake, it can still affect your credit negatively.

    companies sell debt and you are an honest person. Nothing you can do will turn off this machine. Hide, don’t answer calls from anyone you don’t know. This will go on for ten years or more. Even if you pay it off, there will be these sharks that hound you. They buy debt for pennies on the dollar, and will try to collect anything!
    Piss off, hide ,ride it out! I have a car, and a home, and I can get anything I want. Don’t answer your phone, throw away mail. Heck with them!

    Don’t bother with the Statute of Limitations. When you made payments to the collection agent, you reset the SOL.

    The only way a negative item can come off your credit report is if the creditor does it, or they fail to respond to a dispute investigation from the collection agency. I don’t think disputing will help you, because you have a repayment plan in place, thus making your dispute mute to the credit bureau.

    All you can do now is contact the collection agency who is posting this to your account, and demand that they remove the listing once the bill is paid off. You need this agreement IN WRITING! And note that you don’t want it to simply say “paid” because it will still reflect late payments or collections. You want it deleted.

    If they refuse, it’s up to you what to do next. If you quit paying the report will stay for 7 years. If you continue to pay, it won’t look as bad but it will still be a negative.

    If the bill isn’t that great, it’s not likely they will come after you. Validating a home security alarm debt won’t do you much good, as they probably have good enough records to cover it. Guardian is a large company and I’m betting they have good accounting.
