My DH has been paying on a credit card debt with this credit management place. He payed half and then agreed once he gets his next bonus(should be here this month) he would pay the other half. Today he checked our account and 600.00 went through from this company WITHOUT him authorizing it!! Can’t we sue for this? He DID NOT agree to this. The guy sho deals with his account told him “too bad” and then DH asked for a manager and the guy told him that he was the manager. I called the company back, and talked to a different lady.. told her I needed to speak with a manager ASAP. She asked what was wrong. Told her what had happened and she said she would have a manager call us back right away and that the “Tony” guy dh originally spoke with was NOT a manager.
Can’t you Sue them for this if they don’t put the money back in our account?
It would be no problem but we just payed taxes and our mortgage. Ughhhhhh
He told this “Tony” guy that he would call him to put the next payment through WHEN we received the bonus check.

You’re talking to the wrong people. Call your bank.

I would look through the phone book and find a lawyer that does free consultations and ask for one. It depends on if and what was signed at the start of the deal with the credit management place.

I think you have a legitimate complaint. How did they get you banking information to begin with? I think if you authorize them to take money out of your account they should have your voice recorded giving them permission to take out the $ 600.00, on whatever date it is they took it out on. Get your information from the bank and call them back and turn the tables on them and ask them who gave them authorization to take the money out on this date, and that you want proof of it. You will be coming in for the proof and taking it to your attorney to review. If you are able to pick it up don’t tell them you are going to your attorney until they hand over the proof. Also, ask them to highlight where you gave them permission to take this extra $ 600.00. If you ask for the proof and they can’t come up with it they will have to put it back in your account immediately. Make sure you tell them so. If they won’t put the money back into your account and they give you a paper that is showing proof that you didn’t authorize you will have to get an attorney. I hope not but they can’t get away with doing things like this. Also, threaten to call the local newspaper and tell them what they did. See how they like that. You could also call the police and ask them if you have any recourse with this company. Usually going on the news scares the daylights out of them because it hurts their business.

Contact your bank and let them know that there was an unauthorized charge taken from your account and they will send you a paper to fill out regarding the charge then once they get it it will be put back in your account.
