Can marijuana be illegal without an Amendment? Alcohol needed one.

I have an interesting question that I've not seen before, although someone else could have asked it.   "Why is marijuana illegal without a constitutional amendment as required by the overriding legal precedent established by the 18th and 21st Amendments?   (I am not defrending or advocating the use of marijuana, only questioning the "Laws" against it, which then questions actions that Americans have had to suffer from the Government, and then the eventual reach of said "laws" by future Government entities that can then be used against innocent Americans.)   The precedence I speak of is the 18th Amendment: "In the history of the United States , Prohibition , also known as The Noble Experiment , was the period from 1920 to 1933, during which the sale, manufacture, and transportation of alcohol for consumption were banned nationally as mandated in the Eighteenth Amendment to the United States Constitution . _______________________________________________________________________________________________________ So, as identified, the Federal Government/Judicial System established that in order for the Federal Government to restrict the use of anything consumed by individuals (i.e.-alcohol, etc.) required a Constitutional Amendment, as established by the Federal Government's use/production of the 18th Amendment (which would supersedes any and all "Bills' passed by Congress). As an American and with the "Right" established by, "The First Amendment (Amendment I) to the United States Constitution is part of the Bill of Rights . The amendment prohibits the making of any law.......or prohibiting the petitioning for a governmental redress of grievances ." I question how the Federal Government could "legally" restrict anything based on the previously requirement of the 18th Amendment in order to restrict the "sale, manufacture, and transportation of alcohol for consumption..." The big question I ask is, " Based upon the 18th and 21st Amendments, it is obvious that the Federal Government established legal precedent (duh, for those who went through the "public education system).    Then how could the Government legally restrict the consumption of anything, based on the 9th and 10th Amendments of the Bill of Rights (more maybe?)? So, while I am not a consumer or advocate of marijuana, etc., I believe that the law must be administered in the effort to enforce Justice and not to just satisfy "legal" statutes, of course we, 'Real" American know Bastiat,” "When plunder becomes a way of life for a group of men living together in society, they create for themselves in the course of time a legal system that authorizes it and a moral code that justifies it." Frederic Bastiat This is an important question! Even for those against the use of marijuana! If any of you believe in any religion or have a strong set of morals, then you believe in "equal treatment" of people under the "Law", and surprise, surprise, surprise....the American legal system is really a shame and advertises that it (supposedly---have any readers actually been through the system, whether guilty or innocent?) believes in "equal treatment under the law" (unless you are related to a powerful politician, lobbyist, or big financial contributor), but if one is an antagonist/exposer against the "system", then expect to be crushed by the "local" system, which every town, city, State, and Federal establishment has. One will lose their job, be audited, be blackballed in their industry, or have the local police follow them until they "run a red light, fail to yield, etc., and if that is not enough, then the police will fabricate a charge to remove you for "making" waves in their "pond" or upsetting the local political goons (my accusations can be documented if challenged. If someone thinks I'm making this up, then let’s see if anyone responds with support for my claims - read Judge Napolitano’s books, i.e. -easy documentation).   Quite a quandary (!!!!) for the honest and principled Americans and the American legal establishments that have done nothing but abuse/violate The Constitution since there is no "Amendment" making the use of marijuana illegal, as required by the 18th/21st Amendments! Of course, certain "legal" entities froth at the permission they receive from the "Government" and they love to abuse the "People" with their puffed-chests, badges, Courts, and guns.   If the Federal Government admitted ("legally") that (per the 18th and 21st Amendments) that it required an amendment to The Constitution to establish (or repeal) any LAW restricting the consumption of "anything" (food, drug, liquid, etc.), then how in the hell have the American People, or our elected Representatives, in whatever division, the House or Senate, legally allowed such abuse to occur (because they (the representatives) are criminals; and I can defend that position; read Article I, Section XI, paragraph II)? I know why and it is sickening to Real Americans, and I loudly admit that I know that members of Congress, the Senate and House, believe that they're "Above the Law"!!!! We can all name numerous times the "Elite" politicians horribly violate the LAW and then retire to their mansions instead of prison where the average American would be sent! (Uh, why isn't Rep. Rangel in prison for his numerous tax evasion scams?...hmmmm) The "Elite" (rich and about to be richer), their staffs, and their companies are “Above the Law”..   There are those "Above the Law" and then you the American People.....slaves to the "Elite and their establishments" (which can be identified). An Access Idea

As I was in the ER at a local hospital last Sunday and the computer systems in the ER were down, I started thinking about my medical records.   The health care system that I am a part of usually has computers that can access my medical history at any location in the system.  However, not this Sunday.  Just to give some perspective, I loathe going to any doctor.  I absolutely hate having to give the same information over and over.  I have even been known to tell the person "Why don't you just read the chart and history!"  I am also a 20+ year professional in the IT industry and I know that the hardware and software exists to make this a reality.  What doesn't exist is the will on the part of the health care industry or the government to make this happen.   My thought is this:  I want my medical records/history to be put into a format that can be loaded onto a flash drive that I can then carry with me at all times.  I want to be able to update it with my own thoughts (for example supplements I take) and illnesses that I don't go to the doctor for, and I want to be able to have it updated every time I go to a doctor.  The flash drive should be small enough that I can carry it on my key chain without a lot of bulk added.   I don't want my medical records to exist on some national network!!!  Companies and the government have repeatedly shown they are not great at safeguarding personal info as there have been many many leaks.  My health is my responsibility and my medical history is mine!  It does not belong to some insurance or health care network.  I want to be responsible for safeguarding it myself.   Anybody with me?

Health care attitudes – Us vs. Them

People (some people) keep saying that my vote in favor of 'universal health care' is simply me saying that I "want my neighbor to pay my way, instead of getting up and taking care of myself" (This is a quote from another thread.)   My question is:  Given that I do have my own health care solution, and given the whole "neighbor paying the way" thing, can you all please see that I am not voting for my neighbor to take care of me, I am voting, in fact, for the opportunity to help collectively pay for my neighbor!!  I am willing, even eager, to contribute to a general fund and am even willing to wait a day or two for a doctor's appointment, if that means my neighbor who couldn't before can now also see that doctor.     While we're at it, how come when we're all patriotic and stuff, it is "we the people," but when it comes to universal health care, it seems "The government" is some outside force, rather than "Of the people and by the people?"   I am reminded of the joke at the University of Kansas - When the basketball team would win, "Yeah, WE won."  When the team lost, "Boo, THEY lost!!"   I am a very liberal, progressive voter.  The Dems aren't liberal enough for me - And yet, When GW Bush was President, I called him 'President Bush.'  When he enacted something I didn't like, I hoped it would work out , even if I believed it would not.  When people called him a retard, I defended the man, pointing out that he was very smart, funny, and an apparently great father and husband.  I did this because I believe in Democracy and love this country and it's system of government.  My fellow citizens voted for Bush, and I respect our democracy, so I supported our President; as much as it pained me, I supported and defended him.   I am sick from what I see on both sides, when Americans hope that America fails simply so that there will be egg on the face of the President they dislike.   I'll say to the anti-Obama tea partiers just what I said to the liberals who did it with Bush, a phrase I learned growing up on Marine Corps bases:    America, Love It Or Leave It!!!         "Get your government hands off of my Medicare!!"  - Seen on a sign at a Tea Party rally.

Oil Spill – Where is the Govt?

The residents of coastal Louisiana have every right to be angered by the slow response of the White House and the various agencies it directs.  This is looming as one of the greatest man-made disasters in recent history with catastrophic environmental and economic impact to not only the Gulf region but to the rest of us as well.   Only yesterday were officials of the Govt dispatched to the scene.  The Defense Dept has not received any requests for Naval resources and the Chairmain of the Joint Chiefs, as late as today, has stated that they have not even begun to plan mission parameters for this event.  The Coast Guard cannot do this alone and BP officials are only reluctantly accepting Coast Guard estimates of the volume being gushed by the second into the Gulf.   With all the CZARS appointed by the White House in recent months, you would surmise that this country is protected from just about any disaster that might loom ahead, yet, once again, through inaction and failure to imagine a worst case scenario, disaster just isn't looming, it's getting ready to fall on the White House like the Hammer of Thor.   The White House maintains that the cost of this disaster will be on the back of BP.  Easy to say but look at the years of legal wrangling and delays before a single dollar was cast to the victims of the Exxon-Valdez fiasco.   I certainly don't have the answer but I do have a vote come November and I hope it will count.  It's all we common folk have left.   A Government for the People and By the People is a fading dream.

Do you like salt????

Well, do you like salt???? It appears our government is going to restrict the amount of salt companies can put into "our" food. I guess they don't have anything better to do than restrict more of "our" freedoms of choice. There are low sodium foods on the market already for those who don't want the regular amount of salt used. I guess the economy can take a back seat to the salt issue, after all, everyone seems to have a job and are loaded with money under this administration. What say you????

Its OK for VZ to force data plans but pass’s the buck on OB healthcare?

Seems its OK for Verizon to force undue cost's and hardships on its customers with its mandatory data plans but when the government forces more cost on them they pass the buck. Nice huh

Very interesting read and some things that we will all be seeing. I always find it amazing when people think that the Government getting involved in circumstances like this will help. New CARD Act a little unfair

I personally find this new set of laws to be unfair in the aspect that it will discontinue the use of credit card issuance to people below 21.  While it's true that people under 21 can still apply but will have to go through a lot of extra hassle and will even need a co-signer to get one.  I find this to be discriminating.  I'm 18 years old and my score from TU is 756 and 718 with EQ.  I am responsible with my credit and I don't see why I have to be punished just because a lot of my peers are ignorant or are downright stupid when it comes to using credit. I thought I was going to take it slow to develop my credit but seeing the deadline being Feb 22, I can't.  So I ended up applying for two AmExes today (Platinum, and Clear) which I would've waited at least 6 months to a year to do.  While I was instantly approved for both, I know this will definitely hurt my credit score once the inquiries show up on my report.  I surely do agree with the part where card issuers aren't allowed to go to college campuses and give out free stuff to bribe students into getting credit cards I really don't like how they want to shut out under 21s altogether.  Instead of increasing age limits and lowering standards on everything the government is practically increasing the degradation rate of this society.  They should just work on educating people instead.  Without me researching and reading for countless hours i'm sure I wouldn't have achieve the scores I have now at only 18 and a half.

Now that Premier came out with their 79.9% card, congress is considering getting involved to set top rates. Say they set a 40% top limit (number totally made up by me)...will the rest of the cards jump up to meet the new maximum?
