My dad died recently without a will. He filed for bankruptcy one year ago. I’ve found out the house is the only item included. He owed more on thehouse than it is worth. The contents in the home is my only concern. My question is there a way to rtrieve his belongings without probate court? All of my siblings are agreeing I handle the affairs. My concern is having to pay lawyer fees, etc. when the estate is going to be foreclosed on anyway….and there is not enough assests to pay off all his debts!

    You need to talk to the county probate clerk or a lawyer about becoming the administrator of an intestate and possibly small affidavit estate.

    Some states have a small estate affidavid you can self file cheap and without a lawyer; but this is a pretty involved mess and you probably should have the estate pay a alwyer to review everything. Contents MAY need to be sold to settle debt; it’s going to need a professional opinion.

    Condolences to you and your family

    Well out of my experience i can tell you that you will not be able to remove any of the deceased property unless you can prove that the content is in your name and that the property is yours by law unfortunately there is nothing else you can do without physical prove.
    Consult a legal adviser they will give you all the available options, it shouldn’t cost you much if anything if you go through the government / police authority should also be able to help.
